PREAMBLE

  1. The website https://newmood.shop/ is published by Newmood , a limited liability company (SARL) with a capital of €40,000, headquartered at Marrakech Sakar, Marrakesh, Morocco.

    Tentation Newmood SARL is the author of the sales offer for the products presented on its website: https://newmood.shop/ (hereinafter the “Website”).

  2. These General Terms and Conditions of Sale (GTC) apply between Tentation Deco SARL and the Client using the Website.

    The GTC, along with the order form and order confirmation, constitute the sales contract between the Client and Tentation Newmood SARL regarding the purchased Products.

    Any order placed on the Website requires the Client’s prior and unreserved acceptance of the GTC in full. If the Client disagrees with these terms, they must not use the Website.

    Tentation Deco SARL reserves the right to modify these GTC at any time without prior notice, with changes applying to all orders placed thereafter.

    In case of modification, the GTC applicable to the Client’s order are those in effect and accepted by the Client on the date of order placement.

ARTICLE 1 – DEFINITIONS

Terms capitalized in the GTC have the following meanings:

  • “GTC”: This document, governing the relationship between  Newmood SARL and the Client.

  • “Order”: The Client’s purchase of one or more Products via the Website or Customer Service.

  • “Website”: The website https://newmood.shop/, edited by Newmood SARL.

  • “Product”: An item offered for sale on the Website.

  • “Client”: A consumer (adult individual) purchasing Product(s) for personal use via the Website, having accepted the GTC.

ARTICLE 2 – PURPOSE

The GTC define the rights and obligations of Newmood SARL and the Client regarding the sale of Products via the Website.

Use of the Website and Order placement implies full acceptance of the GTC. Only legally capable individuals may place Orders.

ARTICLE 3 – ACCOUNT CREATION

To order Products, the Client must create an account by providing accurate personal information. The Client is responsible for maintaining login credentials securely.

ARTICLE 4 – ORDER PROCESSING

4.1. Orders are placed in French/English via the Website or Customer Service (+212 644-784444).
4.2. Products are added to a cart; the Client may modify quantities before finalizing.
4.3. The Client reviews Order details (price, items) before confirmation.
4.4. Final validation requires acceptance of the GTC.

ARTICLE 5 – ORDER CONFIRMATION

5.1. A confirmation email is sent post-Order.
5.2. The Order is finalized upon payment.
5.3. Product offers/prices are valid as displayed (updated daily).
5.4. If a Product is unavailable, the Client is notified and offered alternatives or a refund.
5.5. Tentation Deco may refuse Orders for legitimate reasons (e.g., payment issues, abnormal Orders).

ARTICLE 6 – PRODUCT PRICES

6.1. Prices are in EUR (tax included). Shipping costs are extra and displayed pre-Order.
6.2. For deliveries outside France/EU, customs/VAT/taxes are the Client’s responsibility.
6.3. Prices may change, but confirmed Orders are honored unless pricing errors occur.

ARTICLE 7 – DELIVERY

8.1. Delivery to the address provided by the Client (France/EU/Switzerland/UK; other countries upon request).
8.2. Shipping costs are specified pre-Order.
8.3. Delivery timelines are indicated pre-Order. Delays may permit contract termination (Art. L.216-2, French Consumer Code).
8.4. Delivery is complete upon Client receipt.
8.5. Unclaimed Products are returned; shipping costs remain the Client’s responsibility.
8.6. Risk transfers upon delivery. The Client must inspect Products and report defects immediately.

ARTICLE 8 – COMPLIANCE, WARRANTY, RIGHT OF WITHDRAWAL

9.1. Legal Conformity Warranty (Art. L.217-4–L.217-14, French Consumer Code):

  • 2-year coverage from delivery (6 months for used goods).

  • Client may request repair/replacement (or refund if impossible).

9.2. Extended Warranty: Specific terms provided with eligible Products.

9.3. Hidden Defects (Art. 1641–1648, French Civil Code): 2-year action from defect discovery.

9.4. Right of Withdrawal:

  • 14-day withdrawal period from Product receipt.

  • Refund processed within 14 days of return receipt.

  • Return shipping costs are Client’s responsibility (unless defective).

  • Custom-made Products are non-refundable.

ARTICLE 9 – PRODUCT USE

The Client must review Product information/usage instructions before purchase/use.

ARTICLE 10 – LIABILITY

11.1. Products comply with French law; Clients are responsible for import/use restrictions in their country.
11.2. Tentation Deco is not liable for manufacturer advice or misuse by the Client.
11.3. Liability is limited to direct, foreseeable damages (excludes indirect/force majeure events).
11.4. No liability for third-party sites linked from the Website or Internet-related disruptions.

ARTICLE 11 – DATA PROTECTION

12.1. Personal data is processed for Order fulfillment per French Data Protection Law (1978).
12.2. Clients may opt out of marketing communications.
12.3. Data may be shared with logistics/service providers or authorities if required.
12.4. Clients may access/rectify data via their account or by contacting contact@newmood.shop.

ARTICLE 12 – SUSPENSION/TERMINATION

Accounts may be closed by the Client or suspended by Tentation Deco for breaches (e.g., payment issues).

ARTICLE 13 – MISCELLANEOUS

15.1. Partial invalidity of a clause does not void the GTC.
15.2. Electronic records constitute valid proof.
15.3. Contracts are archived securely.
15.4. Non-exercise of a right ≠ waiver.
15.5. Force majeure suspends obligations (e.g., war, strikes).
